Manitowoc Herald News, Wednesday, January 04, 1928, Page 4 ******** DECISION ENDS ACTION DATING BACK 19 YEARS Final decision has been handed down by the Wisconsin supreme court in the case of Albert Behnke vs Richard and Lena Kroening, an action dating back nineteen years as the outgrowth of the famous Reedsville dog case of 1902. The action in the supreme court involved a mortgage of $2000, one of three given by Kroening and his wife, allegedly with fraudulent intent. Behnke, who claimed to have purchased the mortgage from the Brillion bank and to have received interest for years, sued to collect but the court rules that Kroening is absolved from payment because Behnke had knowledge of the circumstances under which the mortgage was given. Back in 1902 a dog owned by Kroening was said to have been the cause of a runaway in which a Reedsville man, G.O. Krueger, was killed and suit was filed for $15,000 damage against Kroening, who is alleged to have given three mortgages, totaling $10,000 to Charles W. Behnke, a brother-in-law, and officers of the Brillion bank, with alleged purpose of defeating collection if a judgment was given against him in the damage suit. Later the mortgages were turned in as assets of the bank and remained with the bank when it was sold out to Behnke. Final, two of mortgages were returned to Kroening who made no payments but the third was held by the bank and Kroening refused to pay it. The Behnke's gave Kroening a note for $2000 and a life insurance policy as security that they would return the mortgage on which Kroening had been unable to secure release because of technical defect in recording it. Later the Behnkes purchased the mortgage from the bank and it later was assigned to Albert Behnke who sued on the mortgage. A jury in circuit court rendered judgment in favor of Kroening and on the appeal the supreme court upholds the verdict. Atty. C.D. Brady of the firm of Hougen, Brady & Meyer appeared for the Kroenings and E.S. Schmitz and Friedrith and Hackbart, of Milwaukee for Behnke. It is seldom we see a man remain thirty years at a trade in one place and then go out of business with a clean and unstained reputation. Although Mr. and Mrs. Siegler and their son, William are still to live where we can see them frequently, yet we all feel lonesome not to have them in our midst. The greatest thing a man can leave in a vicinity is a good name and that is what Mr. Siegler leaves in our village and he goes to live a retired life as the blacksmith in Longfellow's poem, "Looking the whole world in the face." WILHELM THUROW (d. 1895) Fire at Reedsville Our neighboring village, Reedsville, was visited by the fire demon on Monday last. Fire caught in the engine room of the elevator owned by Peter Reinemann. The elevator also contained 1400 bushels of grain, all of which was a complete loss. The origin of the fire is unknown. The loss is about $3500 with no insurance. Wm. Turow(sic), an employee, who was working in the upper portion of the building was caught in the fire and burned to death. Mr. Turow was about 40 years of age and leaves an aged mother and sister to mourn his death. The funeral occurred from the Catholic Church Tuesday last. It is said by those that were present that the fire was the fiercest and hottest ever witnessed in that village. It was only by good work on the part of the fire department that it was kept under control and not allowed to catch in adjoining sheds. Brillion News, Fri., July 19, 1895 ********* The elevator of Peter Reinneman of Reedsville was destroyed by fire on Monday afternoon. The origin of the fire is unknown but is supposed to have been caused by a spark from a locomotive. The building seemed to burn as if it were of tinder. William Thurow, who was shoveling grain on the second floor was burned to death. He was at work near a window and might have jumped out with no more serious consequences than a broken limb, but for some reason he made no attempt to escape in this way. Mr. Reinneman had one of his arms badly burned. When he first noticed the fire, in his excitement he seized a sack of flour and took it out of the building. Then he remembered his books and entered the building to save them, but so rapid was the progress of the flames that he was badly burned before he emerged from the building. The loss is about $3,000 with no insurance. Mr. Reinneman has been a wheat buyer in Reedsville for a number of years. The remains of Thurow were taken from the ruins after fire had subsided, badly charred. Dr. Falge but them in shape for burial. Manitowoc Pilot, August 1, 1895 ********* William A. WILHELM UTKE Death in Reedsville Sat. of Wilhelm Utke, a well-known resident of that village, of old age debility. Mr. Utke was born 31 July 1822 in Germany and came to America in 1854, settling in Town Liberty. He served all 4 yrs. of the Civil War in the Union Army. In 1869 he settled in Reedsville where he has lived ever since. He is survived by 4 children. The funeral was held Mon. from the Lutheran Church in Reedsville. Der Nord Westen, 20 Aug. 1903 ********** Early Saturday morning the soul of Wlhelm Utke, a veteran of the Civil War, joined the "Plumed Knights of Eternity" who have passed through the valley into the shadow, which we sometimes call "Beauteous death, jewel of the just," but which is only the dawn of the eternal morning. Mr. Utke was born in Germany July 31, 1822 and was married in Germany also. Coming to this country in 1854, he settled in Liberty, this county. In the summer of 1862, General Sigel was authorized by the President to raise twelve regiments of infantry from among the German population of the loyal states. He sent a request to Gov. Salomon for the formation of one regiment in Wisconsin and under the supervision of Hon. W. H. Jacobs of Milwaukee, the 26th Wis. was formed. To this Mr. Utke belonged under Co. F. It was mustered into the United States service on the 17th of Sept. 1862. The regiment took an active part in the battles of Chancellorsville and Cemetary (sic) Hill and then went with Sherman to the relief of Burnside, at Knoxville. He also was with Sherman in his famous march to the Sea. The company was mustered out June 20, 1868, after which he returned to resume his farm work. In 1869, he moved his family to Reedsville where he has since resided. Although he had always enjoyed the best of health it began failing him this spring and resulted in his death. The funeral took place Monday afternoon. Messrs. Louis Rusch, Chas. Fokett, Fred Getz, F.K. Fisher, Wm. Boettche (sic) and Fred Buboltz were his pallbearers, all men who fought side by side with him during the rebellion. Four children, Theo. of this place, Julius of Marinette, Mrs. J.C. Brockman of Hilbert and Mrs. Aug. Brusse of Peshtigo survive him. Thin are the blue-clad ranks today, once half a million strong. And slow and feeble are the feet that once marched far and long; The tents are spread the low, green tents whose curtains tightly close; No reveille will waken those who sweetly here repose. No more together they will march with slow and broken tramp To all the order will be given: "Break ranks-go into camp." WILLIAM WENZLAFF (d. 1942) Crash Near Reedsville Takes Life of William Wenzlaff, 67 Victim Dies In Local Hospital Two Hours After Car Collision William Wenzlaff, 67, of Cato, route 2, was fatally injured at 4:30 o'clock Thursday afternoon when his car collided with an automobile driven by (private), of Reedsville, on highway 10, a short distance east of the village limits of Reedsville. Wenzlaff died at Holy Family Hospital at 6:15 o'clock last night of internal injuries. (private), who sustained a cut on his chin, was released from the hospital this morning. Dr. Theodore Teitgen, county coroner, ordered an inquest to fix responsibility for Wenzlaff's death and said that the inquest would probably be held in the municipal court room at the court house Tuesday morning at 9 o'clock. A coroner's jury consisting of Mrs. Charles Fuller, John Spoentgen, Ed Jirikovec, Dr. George Huwatchek, Charles Horstman and Walter Wester, was empaneled this afternoon and adjourned after viewing the body of Wenzlaff at the funeral home of the Reedsville Cooperative association. Both Were Alone Both Wenzlaff and (private) were alone in their cars. Wenzlaff was driving east on highway 10 and (private) was driving west toward Reedsville. The cars collided almost head-on on the south side of the concrete. Wenzlaff's car skidded across the road to the shoulder on the north side of the highway. The Wenzlaff machine, a 1926 Graham sedan, was hit on the right front portion of the hood and the right front door. The right front wheel was shoved clear back to the dash board and the windshield and window were shattered. Wenzlaff (Continued on Page 11, Col. 1) CAR CRASH TAKES LIFE OF CATO MAN (Continued from Page 1) was pinned to the front seat of the car. (private) car, a 1933 Chevrolet coach, was also badly damaged. The front wheels were caved in, steering wheel and windshield broken and the front end crumpled. There was one eyewitness to the accident, authorities said, Helmuth Rusch who resides a short distance from the spot where the cars collided. Rusch was driving east toward his home, turned into his driveway and as he glanced toward the village he saw the automobiles come together. Officer Near Scene One of the first to reach the scene of the accident was County Traffic Officer Henry Pleuss who was cruising the vicinity in a squad car and had just stopped in front of a drug store in Reedsville. Notified that an accident had occurred, he went to the scene and called the ambulance over the county police radio. Chief Deputy Sheriff, Gene Spevachek, responded to the call with the ambulance and with Dr. E. C. Cary of Reedsville, removed the accident victims to the hospital. The wrecked cars were taken care of by County Traffic Officers Pleuss and William Ladwig. Dist. Atty. John Danielson, Coroner Teitgen and Sheriff Elmer Bergner also went to the accident scene. Dist. Atty. Danielson said that the fact that both cars apparently felt the impact on the right side would indicate either that (private) was driving on the left side of the road or that Wenzlaff had swung over to the center or left side of the road. May Place Charge Mr. Danielson said that if the information he has been able to obtain is substantiated and the evidence brought out at the inquest warrants it, there is a possibility that either a charge of negligent homicide or manslaughter in the fourth degree might be placed against (private). For the present, however, no charge has been placed against (private). Dr. Teitgen said that Wenzlaff sustained a crushed chest, a fractured left wrist and a gash on the forehead. He suffered an internal hemorrhage. (private) was questioned at the hospital by Dist. Atty. Danielson and was unable to remember anything concerning the accident, the latter said. He was not aware that there had been a collision. Wenzlaff was conscious when brought to the hospital but was unable to make a statement. Funeral Monday William Wenzlaff was born in the town of Maple Grove Feb. 18, 1875. Forty- four years ago, he married Miss Pauline Treichel. They resided in Maple Grove for two years and at Reedsville for 11 years during which time Mr. Wenzlaff was engaged in business as a mason contractor.
