GERALDINE M. KIPPING Geraldine (Geri) Marie Kipping, age 78, of Sand Bay, Sturgeon Bay, passed away Wednesday, Feb. 28, 2007, with her children at her side. Geri married Gerald Kipping on Oct. 21, 1950. They resided in Manitowoc until retiring to their Sand Bay property in 1985. Geraldine bartended Mondays at Merkle's Saloon until May 2006, where she made many new friends but also ran into past high school chums. Geri was never one to sit around and always had a project in the works — whether it was sewing sweatshirts for everyone to making Packer snowmen or wallpapering or painting for others. Her get-up-and-go spirit was contagious; she had no enemies. Being non-judgmental, with an easy going spirit, she truly was an example of a life fulfilled. FRIEDRIC KIRCHHOFF From Der Nord Westen, 02 June 1904: Fred. Kirchhoff, an old resident of Town Manitowoc Rapids, took his own life Thurs. by hanging himself in the barn of his son Louis Kirchhoff with whom he resided. The 78-yr. old man, who lived in our county since 1857, had made several previous attempts on his life because he was depressed by a long-time illness. He leaves a widow and 4 children. ******** FOUND HANGING ON LADDER RUNG Aged Rapids Resident a Suicide After Many Attempts to End Life WIFE CUTS BODY DOWN Son Finds Lifeless Form Hanging in Barn and Calls Mother to Help Him Insane From Long Illness Frustrated in several previous attempts to committ suicide by the watchfulness of relatives, Fred Kirchoff, an aged Rapids resident succeeded in his insane purpose Thursday afternoon and ended his life by hanging, the dead body being discovered in the barn on the premises of Louis Kirchoff, the son with whom he made his home. Despondency caused by ill health which had undoubtedly affected the mind prompted the rash deed, the shock of which has prostrated the aged wife whose condition has become alarming. Evidence is that the deed was premeditated and carefully planned by the unfortunate man who accomplished his purpose by attaching a rope to the rung of a tall ladder and swinging off. The neck was not broken, death having resulted from strangulation. When found Kirchoff had been dead but a short time, the body still being warm. The discovery was made by the son, Louis, who missing his father from the house instituted a search of the premises and upon entering the baran, was met by the gruesome sight. The wife and mother was summoned and assisted in cutting down the body, severing the rope while the son raised the lifeless form to permit this. Kirchoff was 78 years of age and had been a resident of Manitowoc county since 1857, coming to this city from his native land, Germany in that year. He took up his home on Franklin street for a term of seven years and then removed to Rapids where he has been engaged in farming ever since. A few years ago he disposed of his property to his son and had made his home with the children since. He had been in poor health for two years and of late had brooded over the matter, had often threatened to end his life and had made several attempts always being prevented by the intervention of relatives. Besides the aged widow, four children survive, Ferdinand, city, Herman of Dodge county, Louis, of Rapids and Mrs. Bertha Birch, of Fond du Lac. The funeral will be held at Rapids tomorrow at 2 o'clock. CHARLES KIRWAN SON OF JUDGE KIRWAN DIES HERE SUNDAY Attorney Charles Kirwan, Former Ladysmith Lawyer, Dies At Home of His Father A lingering illness of 18 months during which time the best medical attention available was secured, yesterday morning proved fatal to Attorney Charles Kirwan, 52, son of Judge Michael Kirwan and death occurred at the home of his father at 718 N. Eighth street. Attorney Kirwan had been at the home of his father and at the Mayo Brothers Institute at Rochester, Minnesota, for the past 18 months after illness forced him to retire from a lucrative law practice at Ladysmith. Mr. Kirwan was born in Manitowoc in 1877 and after graduating from the north side schools of the city in 1895 attended the state normal school at Oshkosh, graduating from there in 1897. After teaching near Hurley for a year, he entered the University of Wisconsin, spending one year in the general academic department and later graduating with the law class of 1902, being a member of the last class of the beloved dean, General Edwin E. Bryant. Practiced Many Years Admitted to practice in the circuit and supreme courts immediately following his graduation, he entered the law office of W. H. Timlin, an outstanding practitioner of the state at Milwaukee. He located at Milwaukee for two years, later moving to Ladysmith where he practiced continuously until 18 months ago when failing health forced him to give up his work. For four years he was district attorney of Rusk county and served several terms as city attorney at Ladysmith. He never married and in addition to his father he is survived by three sisters, Mrs. Katherine Hogan, Miss Emma Kirwan and Mrs. S. T. Pratt, all of Manitowoc and one brother, Dr. Edward J. Kirwan, Ludington, Michigan. Sudden Death a Shock Although it was generally known that Attorney Kirwan was suffering from a stomach ailment from which there was little hope of recovery, the death yesterday came as a decided shock to those who had known him for many years. During his years of school and college training, he was an exemplary student, always at or near the head of his class. A quiet, reserved type of student, he nevertheless attracted to himself a large circle of close friends as evidenced by his being named president of the law class of 1902 at the University of Wisconsin. Funeral services are to be held from the Kirwan homestead on Tuesday afternoon and interment will take place at Evergreen. Manitowoc Herald News, August 5, 1929 P. 2 ******** Atty. C. Voigt In Tribute To Late Charles Kirwan A tribute to the late Charles Kirwan, who passed away here Sunday at the home of his father, Judge Michael Kirwan, and was buried today, was given yesterday, by Atty. Charles Voigt of Sheboygan, a classmate of the deceased when attending the University of Wisconsin law School. Atty. Voigt said, “It was my fortune to be his classmate at the law school of the University of Wisconsin during the years 1899-1902. He was always one of the leaders in his work. He was modest and thorough; his abilities were solid and enduring, rather than ostentatious or spectacular; his success was the result of labor rather than sudden inspiration. He had a clear and analytical mind; he inherited and cultivated the love of good literature and had a keen appreciation of the beautiful in art. “Many of us have lost a cherished friend—the bar has lost an accomplished lawyer in his untimely death. He was stricken before his time had come and while many years of usefulness might reasonably have been expected to still lie before him.” Manitowoc Herald News, August 6, 1929 P. 2 ******** BEAUTIFUL TRIBUTE PAID AT SERVICES FOR CHAS. KIRWAN A beautiful impressive eulogy of the traits which made the late Attorney Charles Kirwan a distinct credit to the profession which he practiced for many years was delivered by Rev. M. S. Weber of the Ravenswood, Illinois church here yesterday afternoon when services were held for him. Atty. Kirwan was the son of Hon. Michael Kirwan, for many years circuit judge of this judicial circuit… Manitowoc Herald News, August 7, 1929 P. 11 ******** CLAIMED BY DEATH Charles Kirwan, died at the home of his father, Hon. Michael Kirwan, 718 North Eighth Street, Sunday morning, August 4, after an illness of about eighteen months. He was a son of Judge Michael and Mrs. Catherine Nagle Kirwan. He was born in this city in 1877. He went through the north side school grades and was graduated from the North Side school under Prof. Horace J. Evans in 1892 and from the State Normal School at Oshkosh in 1897. He taught school near Hurley during the school years of 1897-1898 and then studied for a year in the academic department of the University of Wisconsin. He then matriculated in the College of Law and was graduated there with the class of 1902, the last class of the beloved dean, General Edwin E. Bryant. Among his Manitowoc contemporaries at the University were R. G. Plumb, Arthur Wyseman, Paul Schuette, Frank Hoffman, Soloman Huebner and Francis and Henry Murphy and Harry F. Kelley and Charles Voigt of Sheboygan were among his classmates in the law school. Admitted to practice in the circuit court and the supreme court with his law class in 1902, he immediately entered the law offices at Milwaukee of W. H. Timlin then and for many years an outstanding figure at the Wisconsin bar and practiced for about two years under Mr. Timlin's guidance. He then located at Ladysmith, where he engaged in the practice of the law and signal success continuously up to about eighteen months ago when failing health compelled him to discontinue his work. He underwent treatment for a considerable time at the Mayo Clinic at Rochester, Minnesota, but neither science nor assiduous loving care interrupted the course of his malady. Early in his career at Ladysmith he drew to himself a desirable practice and served four years as district attorney of Rush County and later several terms as city attorney. Mr. Kirwan was never married. He leaves surviving, his father, his sisters, Mrs. Katherine Hogan, Miss Emma Kirwan, Mrs. S. T. Pratt, all resident of this city and his brother, Doctor Edward J. Kirwan of Ludington, Mich. It has been understood for months that Mr. Kirwan was suffering with an ailment that left but little opportunity for hope, but that death was imminent was not generally known and the death came as a shock to the many friends of his boyhood and youth in this city. During his years in school and college training he was an exemplary student, always at or near the head of his classes. He performed all duties and assigned tasks almost meticulously and without difficulty. He had a distaste for display and a contempt for the student given to unnecessary display of scholarship. A reserve and native dignity of demeanor might have been mistaken for austerity by a new unfledged comrade but he wore it well and had manly traits, social graces and a capacity for attracting that induced many enduring friendships. That is exemplified by his having been given by his classmates, without solicitation or contest, the then most coveted honor in the college of law, the presidency of the senior class, an office traditionally reserved for a combination of standing in scholarship and personal popularity. Mr. Kirwan had a mind of high order, a character that scorned all pettiness and meanness and an honor that was a credit to the spotless name he bore. Those competent to say, express the opinion that in a field of larger opportunity, he would have gone far in his profession. Here is the tragedy of a fine, useful man cut off in this prime. The heart of the community goes out to the father who lately laid down the burden of heavy judicial labors borne with unusual distinction for thirty years and who was fairly entitled to a long period of peace and contentment and who could not but have had some justifiable price in his accomplished and admirable son and to the family who fairly idolized the youngest member, now taken untimely from them. The funeral was held Tuesday afternoon from the home, Rev. Weber officiating. Interment was in Evergreen Cemetery. Among those from outside who attended the funeral were: Judge Edward Voigt, Attys. Charles Voigt, E.R. Bowler, Clarence Whiffen, Editor E. R. Broughton of Sheboygan, Gilbert Hardgrove of Milwaukee, Glenn Armstrong and Attorney S.E. Goodsitt of Ladysmith. JAMES KIRWAN JAMES KIRWAN, JUDGE KIRWAN’S BROTHER, DEAD Prominent in Civic Affairs at Chilton Where He Practiced Law and was Former District Attorney James Kirwan, who in his earlier years was a resident of the town of Meeme in this county, died at the Holy Family hospital in this city on the evening of December 24, to which institution he was brought for care and treatment a short time previously from his home at Chilton, Wisconsin. The funeral was held this morning from the home of Judge Michael Kirwan, North Eighth street, at 8:30 with services at 9 o’clock at Sacred Heart Catholic church, Rev. W. J. Luby officiating. Burial was at Evergreen cemetery. Mr. Kirwan was born in Milwaukee in 1853. In his boyhood he was a pupil at the district school at Osman which was attended by John Nagle and others of his classmates. Subsequently Mr. Kirwan was a student at the Oshkosh Normal school, and was a teacher in the public schools of this county for a time. Thereafter he studied law in the office of General Bragg at Fond du Lac, and while there he passed the state bar examination and then engaged in the practice of the law in that city for some years. He went from there to Chilton at which place he located in 1891, and thenceforth he was in the active practice of his profession at Chilton up to a few weeks before his death. During many years of his residence in Chilton, Mr. Kirwan participated actively in the public affairs of his city and county. He served as the district attorney of that county for more than twenty years. His last service in that capacity was rendered under an appointment to that office by Governor Blaine. Life Long Democrat. In politics Mr. Kirwan was a democrat; and in his time rendered some service to his party and was accorded a prominent place in its local councils. He always reserved to himself, however, a commendable measure of independence in party matters. His retention in office by the people of his county during so many years, and his appointment thereto by a governor who was a member of a different political party show that Mr. Kirwan never permitted his connection with political affairs to become offensive or to influence his official duties; and that his performance of the duties of his office merited and received the approbation of the people of his county. In that service he was guided solely by his sense of duty and knew neither friend nor enemy, and was never influenced in that respect by fear of what the consequences might be to himself personally. Survived by Widow, Two Brothers James Kirwan was by nature a genial and kindly man. He had many warm friends and he possessed unto the end the confidence and respect of his neighbors and acquaintances. Those facts are vouchers for his character. Pope’s famous encomium upon an honest man is descriptive of a trait which was prominent in Mr. Kirwan’s life. His nearest surviving relatives are his widow and two brothers, John Kirwan of Meeme and Michael Kirwan of Manitowoc. Manitowoc Herald News, December 27, 1926 P.1 ********* MEMORIAL SERVICES HELD FOR THE LATE JAMES KIRWAN Hon. Fred Beglinger, circuit judge of Oshkosh and Otto B. KATHERINE KIRWAN MRS. M. KIRWAN PASSES AWAY AT HOME TODAY Wife of Judge Kirwan Summoned After Long Illness Many friends will receive with sorrow the announcement of the death of Mrs. Katherine Kirwan, wife of Judge Michael Kirwan, which occurred at the family home on North Eighth street at an early hour this morning. Mrs. Kirwan had been an invalid for several years and her demise was a release from sufferings which had been borne with fortitude and patience. Born in Canada Mrs. Kirwan's maiden name was Katherine Nagel and she was born in Canada, coming to Manitowoc county with her parents who were pioneer settlers of Meeme. She resided at Meeme until her marriage to Kirwan, removing to this city where during the past fifty five years they have made their home. The late John Nagel for many years owner and editor of the Manitowoc Pilot, was a brother of Mrs. Kirwan. A woman of retiring disposition, Mrs. Kirwan's life was centered in her home and family. She was a devoted wife and mother and was deservedly esteemed by friends who knew her well. Funeral Private The funeral of Mrs. Kirwan will be private. Arrangements have not been completed, awaiting word from members of the family who are not here. Here was a fine old fashioned mother, who could hear no higher duty calling her than to make her fireside an ideal home a place of peace and contentment; to perform the day by day tasks that occupy the attention of a mother rearing a family and making the home a shrine, the memory of which will linger with those reared in its atmosphere and influence every moment of their future lives. Her life was laid and lived in strong and simple lines with a deep and humble sense of obligation to home. Her husband and children have lost in her a wife and mother whose life will be in them a pleasant remembrance. The memory of her virtues will life and soften their grief. For a long time preceding her death, she was precluded from social activities. Her acquaintance was large, her friends were many and her lovable traits of character will not soon be forgotten. MICHAEL KIRWAN, JUDGE JUDGE MICHAEL KIRWAN DIES PIONEER EDUCATOR JURIST WAS 85; HIS FUNERAL THURSDAY Body Will Lie In State at Courthouse Where Bar Association, Citizens Will Pay Tribute To Community Leader Judge Michael Kirwan, 85, jurist and pioneer educator and teacher, who retired from a 30-year term on the circuit bench here at the close of 1928, died at 10:30 Monday evening at the Holy Family hospital. His death followed an illness of several weeks, and when his condition became critical recently he was taken from his North Eighth street home to the hospital. His advanced years precluded his rallying from the complications that developed and he sank into a coma on Monday. Identified as Judge Kirwan with the public, civic and judicial history of Manitowoc county for 68 years, dating back to the time when he took up the teaching profession in the county as a youth of 17 years, his passing was a shock to the community in which he had been such a sterling figure down the long span of years. News of the death of the jurist reached the courthouse this morning just as Judge Edward Voigt, Sheboygan, who succeeded Judge Kirwan on the circuit court bench here, was preparing to open the annual January term of circuit court. He immediately adjourned court out of respect to Judge Kiran. Later announcement was made that the body of the deceased would lie in state in the circuit court rooms on Wednesday, from 2 o’clock in the afternoon until 8 p.m. with a special guard of honor composed of committees from the Manitowoc and Sheboygan county bar association. During the time Judge Kirwan’s body is lying in state at the courthouse, no business will be transacted in any of the offices, County Clerk A. W. Tetzlaff announced today. Funeral Thursday Funeral services were announced for the interment in the family lot in Evergreen cemetery. Rev. D. G. Ristad will be in charge of the services with an honorary escort of pallbearers made up of members of the Wisconsin Bar association and from the membership of the Manitowoc and Sheboygan county fair organizations. Down the long span of years Judge Kirwan was a potent factor in the educational and judicial life of the community. He taught school when not yet reaching his majority in the early days of the old district school system when his old friend, the late Henry Vits, was a director of the school district board. He resigned this position to become judge of the probate court, was admitted to the bar and formed a law partnership with Atty. A. J. Schmitz, now at Milwaukee, and was elected to the circuit bench in 1898, serving for a 30-years period. Refused High Bench The late John Nagle, brother-in-law of the judge and at that time editor of the Manitowoc Pilot, was a potent factor in placing Judge Kirwan on the bench. Thus the judge turned his attention to the affairs of the Fourth judicial circuit. In looking back over his teaching profession he was the proud possessor of the first state certificate for teaching issued to a resident of Manitowoc county. The judge served for many terms as a member of the school boards of the city, and was a member of the board of normal regents for a number of years. With the death of Judge Kirwan two hitherto unknown facts in connection with his life became known. During the administration of President Grover Cleveland, Judge Kirwan was offered the position of federal superintendent of Indian education, but he declined the office. Twice during his term as circuit court judge he was offered appointment to the state supreme bench by a state executive but each time he refused, preferring to carry on his work on the circuit bench in this city. Was Rated High The deceased was an outstanding figure in the county and state and during his years on the bench was rated as one of the best circuit judges in Wisconsin. With an acutely legal mind saturated by the spirit of the law and learned in its letter he brought to the bench the rare talent and resources which won for him early in his career acclaim as a great lawyer. As a man and citizen, as well as a lawyer and judge, he made a noble impress. His mentality was not confined by professional boundaries but extended into wide fields of knowledge and culture. Judge Kirwan was born in England November 1, 1847 and came to… (Cont. on page 6) PIONEER EDUCATOR, JURST WAS 85; HIS FUNERAL THURSDAY (Cont. FROM Page 1… with his parents from that country to Milwaukee in 1849 when only eighteen months old. In 1855 the family came from that city and settled on a tract of wild land in the town of Meeme. In the little log school of that neighborhood he received the groundwork of his education and as the years passed he became noted as a reader of books. He spent his summers working on the farm, attending school during the winter. In the Meeme settlement of those early days the residents sought the very best of English literature. These books passed from hand to hand and were eagerly read by the young men and women of the neighborhood. These Judge Kirwan read and his common school training and these readings were the foundation of his scholarship. After he was graduated from the old log schoolhouse he spent some years in teaching school in different districts throughout the county. He was the first principal of the Two Rivers school when it first reached the dignity of a grade school—1866-67. Shortly after, he moved to this city and for a time was an accountant with the old Manitowoc Dry Dock company. On State Board A little later he was elected County Superintendent of Schools which office he filled from 1870-75. In 1874, while still county superintendent, he was appointed a member of the state board of examiners for state teachers’ certificates, and in 1876 he was elected secretary of the state teachers’ association. During the period from 1890-1896 he was a member of the state board of regents for state normal schools. Thus for a period of over 30 years, starting when he taught school while not yet twenty years of age, he was actively identified as teacher and official with the educational interests of the county and state. At periods during the intervals of his teaching and official labors, Judge Kirwan turned his readings toward the law. On June 26, 1878 on examination in open court he was admitted to the bar. At the spring election of 1877 he was elected county judge without opposition and entered upon his labor the following year. Here he began the task of arranging the files and records of that office and brought order out of the chaos of mixed-up papers and miscellaneous entries in old books of record. Won Respect His administration of the new business coming before him won him the respect and confidence of the bar and the approval of the people. Had he so desired he could have been reelected at the end of his term without opposition. Desiring to enter upon the practice of his profession he announced that he would not again be a candidate. He severed his connection with the office of county judge on January 1, 1882 and entered into a law partnership with Adolph J. Schmitz, the new firm being known as Schmitz and Kirwan. That firm continued until the removal of Mr. Schmitz to Milwaukee 16 years later and did a large share of the law business of the county. When Judge N.S. Gilson of Fond du Lac declined to be a candidate for reelection as circuit judge in 1898 the name of Judge Kirwan was brought forward. The circuit at that time consisted of Fond du Lac, Manitowoc, Sheboygan and Kewaunee counties. Sheboygan county named as a candidate Anson C. Prescott and in the election that followed Judge Kirwan was chosen as circuit judge by a majority of nearly 5,000 votes. On the occasion of Judge Kirwan’s retirement from the bench in December, 1928, he was singally honored by the bar associations of Manitowoc and Sheboygan counties with a testimonial banquet at the Hotel Manitowoc here. At this function the speakers, who included Judge Edward Voigt of Sheboygan, Judge Chester Fowler of Fond du Lac and E.G. Nash, president of the Manitowoc County Bar association, all spoke of the universal esteem in which Judge Kirwan was held by those who had been associated with him during his long career. Among the speakers at the function was Attorney A. J. Schmitz of Milwaukee, first law partner of Judge Kirwan in the earlier days. At the annual meeting of the Manitowoc County Bar Assoication held in January, 1930, Judge Kirwan was honored by being elected president. Judge Kirwan was married in 1868 to Miss Catherine Nagle, member of a pioneer county family. She passed away in 1925. Of the six children born to the couple three survive. There are two daughters, Mrs. T. W. Hogan, city, and Miss Emma Kirwan, clerk of the board of education here and one son, Dr. E. J. Kirwan of Ludington, Mich. Another son, Timothy Kirwan died many years ago, while a third son, Atty. Charles Kirwan of Ladysmith and a daughter, Mrs. Blanche Pratt died in more recent years. TIMOTHY KIRWAN TO SHADOWY REALMS Timothy Kirwan, son of Judge and Mrs. M. Kirwan, died at the home of his parents on North Eighth Street at 1 o'clock this morning. For nearly two years he has been a sufferer from consumption and death came as a welcome relief. The deceased was born at Meeme, this county, March 8, 1868 and moved with his parents to this city when but a child. For a number of years he was employed in Milwaukee, but was obliged to give up his position on account of failing health. About eighteen months ago, he returned to his city and has since remained here. For some time past it has been apparent to his friends that he could not survive, but ever of a hopeful dispostion, he clung to life with a persistency which characterizes victims of the dread disease and when he too, realized that his hours on earth were numbered, he accepted the inevitable with calm resignation and passed to shadowy realms with a smile on his wasted lips. The deceased was a young man, highly respected by all who knew him. Kind and considerate in his dealing with others, generous to a fault, his friends were limited only by the number of acquaintances. Funeral services will be held from the late home Friday afternoon at 2 o'clock. Manitowoc Daily Herald, Dec. 28, 1898 page 1 ******** Manitowoc, Wis., Dec. 29 (Special) Timothy Kirwan, son of Judge and Mrs. Michael Kirwan, passed away at the home of his parents on North Eighth street yesterday morning at the age of 31 years. The deceased had been ill with consumption for nearly two years and was obliged to give up his position in Milwaukee on account of failing health. He was a young man of more than ordinary intelligence and possessed qualities of mind and heart which won him friends wherever he went. The funeral services will be held from his late home tomorrow afternoon at 2 o'clock. Wisconsin Weekly Advocate, Dec. 29, 1898 ********* TIM KIRWAN died at the home of his father, Judge Kirwan, in this city on Tuesday night Dec. 27. He has been sick for a long time with tuberculosis of the lungs. He became sick while in Chicago where he was in the employment of a transportation company. He was born in Meeme in 1868. He was an unusually bright boy and when 17 years old was appointed to West Point. Military life was exceedingly distasteful to him and he quit West Point after a year's study there. He secured employment with a transportation company in Chicago and remained in its employment until the time of his sickness. During his sickness he sought relief by residence in Arizona, but all to purpose,(sic), he came home with the feeling that the period of his life was drawing to a close. The best test of a man's intrinsic worth is the esteem in which he is held by his associates. Tim Kirwan had qualities which endeared him to all with whom he was familiar and they sincerely mourn his untimely death. His worth required for its full manifestation that the maturity of years overcome the repression of a young life strangely undemonstrative. He had an acute mind, strong and persistent, and a heart charged with sympathetic feeling, but never given to emotional display. One had to delve to the deepest stratum of his nature to find the sterling qualities which formed his character. He never courted favors and instinctively despised flattery and hypocrisy. His love of friends was too deep for forms of shallow expression. He died in the home he loved and among the relatives he cherished bringing the beginning and the end among environments that are holy and which are vouchsaved to few. Death came with that slow but unfaltering step which tests courage to the utmost, but the victim did not repine at the sacrifice he was called upon to make. He met death with the courage of strong manhood and the philosophy of a man who can school himself to suffer without making complaint. Manitowoc Pilot, December 29, 1898 P. Mr. Kitzerow died August 2, leaving an estate estimated at $6000. According to the terms of the will, Walter Kitzerow, a son with whom the father lived received $5,500 and another son, Alfred of Chicago, $400. The balance was left to the seven daughters, "share and share alike". The purported will was drawn up on April 19 and signed by Walter Detjen and Charles Fechter as witnesses. Further charging that the will was not executed as required by law, that their father's signature was procured by the exercise of undue influence by Walter and that their father was mentally incompetent to make a will at the time it was drawn up, the eight children and heirs at law ask that the document now on file with Miss Irma Schmitz, register in probate, be adjudged not to be their father's will. The case will be heard some time in September when Judge John Chloupek returns to preside in country court. The will was entered for probate by Henry Detjen, executor. Seven daughters, Mrs. Tillie Schneider, Hortonville, Mrs. Ernestine Bergelin, Denmark, Mrs. Amanda Spevacek and Mrs. Elsie Dufek of this city, Mrs. Ella Siegel, Fox River Grove, Ill., Mrs. Anna Riebe, Green Bay, Mrs. Delia Hansen, Milwaukee and one son, Alfred had the objection filed. Hougen & Brady are attorneys for the contestants. Manitowoc Pilot, Thurs., Aug. 28, 1930 ******** KITZEROW WILL SET ASIDE County Judge Chloupek set aside the will of the late Carl Kitzerow Monday. The will bequeathed about $5500 of the $10000 estate to one son, Walter and the remainder to eight other heirs. The court held that age was not the determining factor in the ruling rejecting the will, pointing to the fact that leading figures in the world war were advanced in age but retentive of their strong will and mind. Judge Chloupek, however, held that the evidence established that Kitzerow was subject to senile dementia and that he was in fear and under influence of his son, Walter and that it was not his will and that he was not competent to make a will at the time the one in question was made. In his decision the court received evidence tending to show that the man had twice attempted suicide, told of the farm having been disposed of so that the man could move to the city, of his being dissatisfied with city life to result in the re-purchase of the farm. After the property was again sold, the man and his wife moved to the home of a daughter and then later purchased their own home. While there was no evidence to show who conducted the first deals, testimony showed the second deal had been transacted by the wife, that nothing was done by him in the purchase of the home here and that interest on the farm mortgage was paid to the wife who preceded him in death. After the death of the wife and mother, a son, Alfred at Chicago, indicated he did not believe everything was as it should be, the court said, but the son later withdrew from participation in the suit. The court held that there was no question of the proper execution of the will but said that the signing witness had only a slight acquaintance with Kitzerow and that testimony that Kitzerow was suffering from senile dementia had been substantiated. The contested will left $5500 to the son, Walter in this city; $400 to a son, Alfred at Chicago and directed that the balance be given his seven daughters share and share alike. JOS. KLASKA TRIED TO KILL HIMSELF Jaroslav Klaska Attempts Suicide But Life is Saved In a temporary fit of despondency, Jaroslav Klaska, a resident of the north side attempted to take his life by drinking a quantity of hydrochloric acid Tuesday afternoon. He had repaired to Evergreen cemetery in the vicinity of which he lived, and there took the poison. Discovery of the fact was made by members of Ferdinand Heyroth’s family who saved his life by the application of the chemistry theory that soap suds and milk form an excellent combatant and antidote for this acid and by pumping the man’s stomach full of this mixture successfully offset the effects until the arrival of Dr. Gleason. The man writhed in agony for hours but it is expected he will live. No reason is ascribed for the man’s act other than that expressed by himself in which he stated that he was tired of life and had sought the means employed to end his existence. Klaska is a divorced man about forty years of age and has on several previous occasions given evidence that he might attempt to do himself bodily harm. The episode created quite a little excitement in the neighborhood for a time. Manitowoc Daily Herald, April 5, 1905 P. 1 ******* [age 45 yrs./cause: poisoning] ******* (An obituary couldn't be found. CHARLES N. KLEIN (d. 1947) Ill Health Leads Man To Take Life Believed to be despondent because of ill health and said to be fearing a nervous breakdown, Charles N. Klein, 64, who resided a short distance off Memorial drive north of the Cape Cod Inn, took his life about 9:30 this morning in a bedroom of his home by leaning over a 12-gauge shotgun and pulling the trigger with a two- foot stick. Coroner Theodore Teitgen said the blast from the single barrel gun went through a portion of the man’s head and he died immediately. No inquest will be held, the coroner stated, terming the death a suicide. Wife Heard Blast Klein’s wife, Anna, told Sheriff Arthur Turttschel that she was seated in the living room of the residence with a young grandchild when she heard the gun discharged in the upstairs room. Fearing to investigate herself, Mrs. Klein ran to the house of a neighbor and telephoned the sheriff who arrived a short time later and found the man dead on the bedroom floor. Mrs. Klein told the sheriff and coroner that although her husband had been suffering from a recent nervous condition, he had given no indication that he contemplated taking his life. Klein had been employed at the Hamilton Manufacturing company in Two Rivers but had not been working since last April.
